Consular legalization

The function of Consular Legalization is to confirmcompliance of documents with the law of the issuing country in order for themto be recognized as valid in the foreign country. It is a procedure ofcertification of authenticity of signatures of the officials authorized tocertify the signatures on documents, the capacity in which the person signingthe document acted; and also the validity of prints of stamps/ seals by whichthe document is fastened.

Documents requiring legalization, notarized by apublic or a private notary, will first have to be taken to the Ministry ofJustice of the RussianFederation (Legalization Section). Pursuantto Clause 6.41 of the Resolution on the Ministry of Justice, approved byPresidential Decree No.954 on August 2, 1999 (with the amendments of June 8,2000), the Ministry certifies authenticity of the notary's signature and seal/stamp. The documents will next have to be legalized by the Consular Departmentof the Ministry of Foreign Affairs of Russia. Then they are certified in theEmbassy or Consulate of that country for which they will be legalized.


Mutualrecognition of public documents

There are several countries which Russia (independently, or as the USSR) hassigned agreements with on mutual recognition of public documents. This meansthat public documents, properly executed in one country party to the agreement,will be recognized by another country party to the agreement without anyformalities (the only requirement is that documents requiring legalization needto be translated in the language of the destination country). Public documentsdo not have to be apostilled for these countries. Russia has signed such agreementswith:

CIS countries (Armenia, Azerbaijan, Belarus, Georgia,Kazakhstan, Kyrgyzstan, Moldova, Tajikistan, Turkmenistan, Ukraine,Uzbekistan); as well as Albania, Algiers, Bulgaria, Bosnia and Herzegovina,Croatia, Cuba, Cyprus, Czech Republic, Estonia, Hungary, Korea (People'sDemocratic Republic of Korea), Latvia, Lithuania, Macedonia, Mongolia, Poland,Romania, Slovakia, Slovenia, Spain, Tunisia, Vietnam, former Yugoslavia (Serbiaand Montenegro).
